GYMORCA PRIVATE & SEMI-PRIVATE COACHING – TERMS & CONDITIONS

Effective upon signing the coaching agreement.

GymOrca provides private and semi-private coaching focused on fitness, health, and postpartum recovery. Services are delivered by certified trainer either:

• In person at:
  GymOrca – 850 Saint Ambroise St, Suite #100, Montreal, Quebec H4C 3N8
• Online, where applicable and agreed upon in advance.

Your program may include:

• Customized training sessions
• Meal planning and guidance
• Progress check-ins
• Client support via app or messaging platforms

By signing your agreement, you agree to:

• A set period of coaching (as defined in your contract)
• Monthly payments, automatically charged to your credit card through the GymOrca App
• Payment on the same date each month for the entire contract period

Your spot is exclusively reserved for you. All plans are non-transferable and non-shareable.

If you choose to cancel before your agreement ends for any personal or urgent reason:

• A 30% cancellation fee applies on the remaining unpaid balance
• No refunds will be given for services already used:
  • Completed sessions
  • Meal plans
  • Consultations or check-ins
  • Program modifications or custom resources

All cancellations must be sent in writing to:

If you need to pause your subscription:

• You may freeze your contract for a $50/month hold fee
• This freeze holds your spot and rate
• The freeze period must be requested at least 7 days before your next billing date
• Max freeze limit: 4 weeks per 6-month contract (unless medical emergency with proof)
• Your contract term will be extended by the freeze duration

Under sections 190–196 of the Québec Consumer Protection Act, you may cancel your contract at any time.
If cancelled:

• Before sessions begin: No fees apply
• After sessions begin: You only pay:
  • For the sessions received (at your contract rate), and
  • The lesser of $50 or 10% of the remaining unused balance

Refunds (if owed) are processed within 10 business days

• You must provide 24 hours’ notice to cancel or reschedule any session
• Cancellations made within 24 hours are non-refundable and marked as used
• No-shows = loss of session, no exceptions
• If GymOrca cancels for any reason, we will reschedule at your convenience

To maintain a respectful, clean, and safe space for all GymOrca clients:

• Arrival: Be at the gym 10 minutes early
• Gym Code: Your private entry code is confidential. Do not share it
• Clean Your Space: You must wipe down all equipment and clean your area before leaving
• Personal Items: Keep your area organized. GymOrca is not responsible for lost/stolen items
• Bringing a Baby: You are 100% responsible for your child’s safety. GymOrca staff do not supervise babies

Violation of these rules may result in removal from the program without refund.

By participating in this program:

• You confirm you are medically cleared to exercise
• You accept all risks involved in physical activity
• GymOrca are not liable for any injuries, health events, or damages
• Maximum liability is limited to the amount you paid for services

All personal, health, and coaching information is kept strictly confidential. We only share information if:

• Required by law, or
• There is a clear concern for your safety or the safety of others

• All disputes will first go through mediation
• If unresolved, the matter will be handled through binding arbitration under Québec law

These terms are governed by the laws of the Province of Québec and Canadian consumer protection laws.

Any changes to your coaching contract must:

• Be made in writing
• Be signed or approved by both you and GymOrca

By signing your contract, you agree to:

• The length of the agreement
• Monthly billing for the full duration
• All terms listed above, including cancellation fees, freeze policy, and responsibilities while using GymOrca facilities
